Administrative opposition

According to patent & trademark law of Iran, administrative opposition is possible.

A. Who has the right to file administrative opposition?

1.       Person or company who consider the trademark to be their own.

2.       Person or company who consider the applicant’s trademark sufficiently resembling their own that it might confuse the general public.

B. Is there any time limit for filing an administrative opposition?

The objector has 30 days from publication date of the application in the official gazette to file an administrative opposition.

C. What if the objector has no prior trademark registration in Iran? 

According to patent & trademark law of Iran if the objector has no prior trademark registration in Iran, it must file an application for trademark simultaneously with administrative opposition.  Furthermore the applicant must pay the application and registration fee in advance.

D. What if the applicant reject the administrative opposition?

The objector has the right to file a petition before the court for verdict.  The objector must file the petition before the court within 60 days from the date that administrative opposition has been served to the applicant.

E. What if the applicant accept the administrative opposition?

The applicant’s application will be canceled and the registration process will start for objector’s application if one has been filed.
