Use requirement

According to patent & trademark law of Iran, a trademark is vulnerable to cancellation due to non use, the conditions are:

1. If plaintiff proves to have priority right in respect of a trademark resulting from prior usage, the court shall hold that the trademark be registered in the name of the plaintiff and if the said trademark has already been registered in Iran the court shall hold that former registration be canceled.

2. If a trademark has not been used in Iran or abroad within three (3) years from the registration date and if the owner or his legal representative fails to furnish a valid reason, any interested party may apply to the court and request cancellation of trademark.
